Exclusive Commercial Rights for NFT Holders of their DAC NFTs

Proposed executors: Notthe1#9917 for legal drafting & review. Aheros#6374 for recording of the legal agreement into an NFT for clarity and future viewing and creation of the Commercial Opt-Out sheet/flow.

Proposal details:

1.) Draft the required legal documents to grant full commercial rights of each NFT to rest solely with the NFT holder except for that the project itself (Dope Ape Club DAO) will be able to use any and all NFTs in the collection for promotional/not-for-profit purposes of the DAO.

2.) If in the future the DAO fully passes in the affirmative a proposal on Snapshot to use the NFTs from the collection in some fashion other than for promotions or non-profit use as above in section 1 (say to create accessible merchandise on its website) then profits will be split with said NFT holder 50%-50% unless a different agreement with the individual holder is made. Owners can individually opt-out of this in writing and a process will be outlined in the IP license agreement this proposal aims to draft.

3.) In all other ways the holder of an NFT will have exclusive commercial rights over their NFTs to create, distribute, sell, license or otherwise utilize as they choose in enterprises which do not engage in any illegal activity, or on behalf of any hate group, or support discrimination, so long as they own that NFT.
