Today is the day we all come together and exercise our autonomy. Once again, we have had conversations and the fruitfulness of those conversations has led us to this point. Who knew, 4 months ago that we would be here today having such lofty aims and discussing things we had not even fathomed.
GU has literally exploded onto the scene, but there is still much work to do. We as a community provide value to the GU collection. Not because it is not valuable enough, but rather, it is Fine Art, it has intrinsic value and we as a community will unlock its full potential. We are looking to do this by bringing this masterpiece pixel art collection into more and more people's eyes and each and everyone of you is helping to achieve that goal, daily. We are also doing this by establishing a brand identity and creating a rich lore around this collection which will ultimately add a 3rd dimension to this collection.
As our chaotic formation occurred in the early days of GU we as a community were of the opinion this was a CCO project, mistakenly so. In a recent conversation with the Artist / Founder I asked him frankly if the collection has had a CC0 licence approved - I was told that no CC0 licence has been applied for or approved. This provides us with a new opportunity. On further probing I asked the artist if he would be willing to transfer the full IP rights of the collection to the GU collective or a company that would represent the GU collective. His answer was “Yes”. THe artist is willing to transfer full Ip rights to the GU collective.
Over the course of the last couple of weeks we have discussed IP rights and CC0 rights. We have had conversations about which form of rights would most benefit and IP like GU. Below I will clarify what IP is and what CCO is.
IP rights - are specific rights pertaining to an Intellectual property (a piece of art, a brand and or other creations) which are documented in a legal document that detail how the intellectual property can be used by others. In our case, the IP rights can be tailored and dictated in a way that best serves the purpose of our community. Essentially, having IP rights means that those who seek to use our Images, branding, logos, lore and or any other IP we create will have to ask express permission before doing so. AS for the actual details of the Guidelines we will create them in tandem with discussions with our community and vote them in at a later date.
CC0 - The IP (intellectual property - art) - would be in the public domain and anyone would be able to use it without permission and monetise it - uncapped.
Today we vote whether we, as a community, start moving towards owning the IP of Genuine Undead.
For transparency, setting up an IP, this would involve the following.
The artist and Founder would need to prove to a lawyer that he owns the collection.
We would need to set up a Holding company that is prepared to hold the IP rights once transferred.
Full IP rights would then need to be transferred from the Founder to the Holding company representing the GU Collective.
Once received (the Full IP rights of the GU collection to the GU collective) - IP guidelines would be produced that document the use and the rights allocated to the holders of the NFT as well as the restrictions for its use.
Please note, this vote is not to establish what those rights are. If the vote passes and the community decides that they would like to move towards IP rights, we will then begin this process. Receiving the rights we will have developed a draft set of IP guidelines which too will be discussed, as always, and then taken to a vote of confidence prior to enacting them.
SO in summary:
Vote today is whether or not the GU collective should own the IP rights to the Genuine Undead Collection.
